Tanning Bed Operators
The Skin Cancer Prevention Act is a law aimed at protecting youth from the harmful effects of ultraviolet (UV) radiation from tanning beds. Under this legislation, it is illegal to:
- Provide, sell, advertise, or market tanning services to individuals under 18
- Share false or misleading information about the health risks or effects of tanning bed use with youth under 18
This legislation protects youth from harmful UV radiation, a known risk factor for skin cancer. By following these regulations, tanning facility operators contribute to the health and safety of their communities.
What are the responsibilities of tanning bed operators?
Operators of tanning facilities must comply with several legal requirements outlined in the Act:
Required signage in tanning facilities
Operators must display the following signs:
- Point of sale warning sign: Within one meter of each cash register
- Health warning sign: Within one meter of every tanning device
- Age restriction and government identification sign: Above or near the door handle at each facility entrance
- Employee reminder sign: Visible to staff at the point of sale
Age verification
Operators must:
- Refuse tanning services to anyone under 18 years old or anyone unable to provide acceptable identification proving they are 18 or older
- Request identification from anyone appearing under the age of 25
Advertising and marketing
- Operators must ensure advertising or marketing does not target individuals under 18
Protective eyewear
- Operators must ensure protective eyewear is used by all patrons and provide clear instructions on proper use
Notify Southwestern Public Health
Operators must notify Southwestern Public Health before starting operations by providing:
- Contact information for the owner/operator
- The facility's address and name

Complaints and inspections
Southwestern Public Health enforces the Skin Cancer Prevention Act by conducting complaint-based inspections of tanning facilities. Inspection reports are summarized and posted for two years on Health Inspect.
