Tanning Bed Operators
Skin Cancer Presentation Act (Tanning Beds), 2013
The Skin Cancer Prevention Act protects youth from the harmful effects of ultraviolet radiation from tanning beds. The Act makes it illegal to provide, sell, advertise, and market tanning services to youth under the age of 18. It also makes it illegal to provide false or misleading information about the health risks or health effects of tanning bed use to anyone under the age of 18.
Tanning Bed Operator Requirements
Tanning bed operators have responsibilities under the Skin Cancer Prevention Act, including:
Posting Required Signage:
Point of Sale Warning Sign (post within one meter of each cash register).
Health Warning Sign (post within one meter of each piece of tanning equipment).
Age Restriction and Government Identification Sign (post above or close to the door handle on every entrance to the establishment).
Employee Reminder Sign (post where it is visible to staff at point of sale).
Asking for Identification:
- Refuse services to anyone under the age of 18 or who cannot show acceptable identification proving they are 18 years of age or older.
- If a person appears to be under 25 years old, you must require them to show you identification.
Ceasing Advertising and Marketing
- Do not provide advertising or marketing that is targeted to youth under the age of 18.
Ensure Protective Eyewear
- Protective eyewear must be used and proper instructions on usage must be provided to patrons.
Provide Notice to Southwestern Public Health
- Provide notice of operation to Southwestern Public Health prior to operating, including the owner/operator contact information, address of the facility, and name of the facility.
- Use this form to provide information to Southwestern Public Health.
Complaints and Inspections
Southwestern Public Health enforces the Skin Cancer Prevention Act and completes inspections of facilities on a complaint basis. A summary report on complaint-based inspections will be posted for two years on Health Inspect.
