Enforcement Activities
The Health Inspect Southwestern website includes the following enforcement activity information:
Offence Notices (Tickets)
Tickets can be issued for infractions observed by a Public Health Inspector during an inspection (or re-inspection). Set fines for non-compliance range from $55 to $465.
Summonses
A summons can be issued instead of a ticket for a more serious or repeated infraction, which requires the person charged to appear in an Ontario Court of Justice to answer to the charge.
Orders
If a public health inspector deems a health hazard exists, an order may be issued to remedy the existing hazard. An order may include closing the premises or a part of the premises.
Convictions under the Health Promotion and Protection Act are listed for two years. Convictions under the Smoke-Free Ontario Act are listed for a period of five years from the conviction date.
